高銀通知銷監局「傲玟」已於5月26日起暫停出售

由高銀金融(00530.HK)主席潘蘇通私人持有的何文田住宅項目「傲玟」,於今年8月27日被取消預售樓花同意書。根據一手住宅物業銷售資訊網顯示,「傲玟」的賣方於昨日(7日)通知一手住宅物業銷售監管局,「傲玟」所有曾在載有銷售安排的文件中公佈出售的指明住宅物業,已於今年5月26日起暫停出售。 銷監局表示,《一手住宅物業銷售條例》(第621章)就銷售一手住宅物業時,售樓說明書、價單、銷售安排、成交紀錄冊、示範單位、參觀現樓、廣告,以及臨時買賣合約和買賣合約須載有的強制條文等事宜,訂立詳細規定。《條例》亦禁止作出失實陳述和傳佈虛假或具誤導性資料。 就未落成發展項目或尚待符合條件的已落成發展項目,《條例》規定買賣合約須載有強制性條文,述明如賣方於指明的日期或之前未能完成發展項目,則買方可撤銷買賣合約,而賣方須於合約撤銷後的7日內,將買方根據合約支付的所有款項,連同該等款項的利息,退還買方。如買方不在指明的日期後的28日內撤銷合約,則買方即當作已選擇等待發展項目完成。在此情況下,賣方須向買方支付買方根據合約支付的所有款項的利息。 按買賣合約的強制性條文,即使買方沒有在上述的時限內撤銷合約,如發展項目未能在指明的日期或經批予延後的日期起計的六個月內完成,則買方亦可撤銷合約,而賣方須於合約撤銷後的七日內,將買方根據合約支付的所有款項,連同該等款項的利息,退還買方。假如買方認爲賣方未有履行有關合約條文,可考慮就其應有的權利向賣方提出民事訴訟。
