因用户發佈《雲南蟲谷》剪輯片段，西安中院判決抖音天價賠償騰訊超3200萬
近日，長短視頻版權之爭有了新進展。2022年10月26日，西安市中級人民法院就《雲南蟲谷》案作出一審判決。法院認為，抖音平台上有大量用户對涉案作品實施了侵權行為，雖然抖音採取措施減少了侵權作品的數量，但侵權行為仍未得到有效遏制。抖音因此屬於幫助侵權，應立即採取有效措施刪除、過濾、攔截相關視頻，並賠償騰訊經濟損失及合理費用3240餘萬元。
該案中，西安中級人民法院以每集200萬元、總額超過3200萬元的標準，打破了全國同類案件的判賠記錄，是去年最高記錄的16倍、部分同類案件的上百倍。3200萬的金額，也是騰訊獲得的影視版權類案件最高賠償，不僅超過了本案騰訊最初索賠金額的3倍，也刷新了全國法院網絡影視版權案件賠償記錄。對陝西法院來説，這還是第一次。
原吿騰訊公司發現，2021年8月30日《雲南蟲谷》在騰訊視頻獨播之後，抖音上存在大量用户上傳的該劇剪輯片段。於是在2021年9月22日，向西安市中級人民法院起訴，要求抖音立即採取有效措施刪除、過濾、攔截相關視頻，並賠償經濟損失及合理費用1000萬元。
本案於2021年10月8日由法院正式受理，並由副院長姚建軍親任審判長。案件開庭前，騰訊公司變更訴訟請求，將索賠金額上升至9000萬元。
抖音抗辯稱，相關視頻為用户自行上傳，平台用户數量眾多，抖音不可能對海量信息進行實質審查；且根據法律規定，抖音平台僅提供信息網絡存儲服務，沒有內容審查義務。平台已經提醒用户上傳內容不得侵犯他人知識產權，並履行了通知刪除義務，故不構成侵權。
2022年10月26日，西安市中級人民法院作出一審判決。法院認為，抖音應對平台內侵權內容承擔相應的管理義務，雖然其採取措施減少了侵權作品的數量，但侵權行為仍未得到有效遏制。故法院認定抖音構成幫助侵權，要求其立即採取有效措施刪除、過濾、攔截相關視頻。
綜合考慮涉案作品類型、製作成本、知名程度、被吿侵權行為性質、可能獲益等因素，法院酌定騰訊因侵權行為遭受的經濟利益損失為平均每集200萬元、總計3200萬元，並要求抖音支付騰訊42萬餘元的合理維權費用。法院還在判決中指出，本案不適用於懲罰性賠償。
本案所涉作品《雲南蟲谷》為騰訊公司旗下企鵝影視出品的懸疑冒險網絡劇，改編自天下霸唱小説《鬼吹燈之雲南蟲谷》。全劇共16集，豆瓣評分6.1，有超過15萬用户標記"看過"此劇。
此前，愛奇藝曾因盜墓筆記之《老九門》起訴快手，在2022年8月獲得終審判決，該劇總計48集，獲賠100萬元，平均每集2萬多元。
事實上，《老九門》的獲賠已相對較高。此前，各地法院同類案件的判賠金額整部作品也僅在幾萬元到百萬元之間。
知識產權數據分析機構知產寶發佈的《2021年視頻類案件對判賠金額產生影響的權利作品相關因素研究報吿》顯示，2021年全國法院做出的可公開檢索的視頻類侵權判決共2549篇，獲賠總金額大部分集中於5萬元以下。其中電視劇類的最高獲賠金額為40集電視劇《春風十里不如你》的200萬元，即每集5萬元，僅為本案的1/40。
抖音相關法務負責人表示，將對本案提起上訴。
