國務院：內地學科類培訓機構一律不得上市融資 嚴禁資本化運作
據《新華社》上周六(24日)報道，中共中央辦公廳、國務院辦公廳印發《關於進一步減輕義務教育階段學生作業負擔和校外培訓負擔的意見》。《意見》提出堅持從嚴治理，全面規範校外培訓行為，具體涉及以下三方面措施，第一是堅持從嚴審批機構、第二是規範培訓服務行為、第三是強化常態運營監管。
第一是堅持從嚴審批機構，各地不再審批新的面向義務教育階段學生的學科類校外培訓機構，現有學科類培訓機構統一登記為非營利性機構。對原備案的線上學科類培訓機構，改為審批制。各省要對已備案的線上學科類培訓機構全面排查，並按標準重新辦理審批手續。未通過審批的，取消原有備案登記和互聯網信息服務業務經營許可證(ICP)。
依法依規嚴肅查處不具備相應資質條件、未經審批多址開展培訓的校外培訓機構。學科類培訓機構一律不得上市融資，嚴禁資本化運作；上市公司不得通過股票市場融資投資學科類培訓機構，不得通過發行股份或支付現金等方式購買學科類培訓機構資產；外資不得通過兼併收購、受托經營、加盟連鎖、利用可變利益實體等方式控股或參股學科類培訓機構。已違規的，要進行清理整治。
第二是規範培訓服務行為，建立培訓內容備案與監督制度，制定出台校外培訓機構培訓材料管理辦法。嚴禁超標超前培訓，嚴禁非學科類培訓機構從事學科類培訓，嚴禁提供境外教育課程。校外培訓機構不得佔用國家法定節假日、休息日及寒暑假期組織學科類培訓。培訓機構不得高薪挖搶學校教師；不得洩露家長和學生個人信息。根據市場需求、培訓成本等因素確定培訓機構收費項目和標準，向社會公示、接受監督。
第三是強化常態運營監管，嚴格控制資本過度湧入培訓機構，培訓機構融資及收費應主要用於培訓業務經營，堅決禁止為推銷業務以虛構原價、虛假折扣、虛假宣傳等方式進行不正當競爭，依法依規堅決查處行業壟斷行為。線上培訓要注重保護學生視力，每課時不超過30分鐘，課程間隔不少於10分鐘，培訓結束時間不晚於21點。
