申萬宏源(06806.HK)：法院判決龐鵬遠向宏源匯富支付業績補償款1000萬元
格隆匯9月24日丨申萬宏源(06806.HK)發佈公告，公司所屬子公司宏源匯富創業投資有限公司訴龐鵬遠、山東思源水業工程有限公司股權投資糾紛案，訴訟請求：(1)判令被告一、被告二共同向原告支付2011年業績補償款875萬元，並從2013年1月1日起按年利率10%計算利息至實際給付之日；(2)判令被告一向原告支付2012年業績補償款1000萬元；(3)判令原告前述第2項訴訟請求對被告一質押的706.978125萬元份額被告二股權拍賣、變賣所得價款享有優先受償權；(4)判令被告一支付回購原告持有的被告二6.5%股權的股權受讓款72,465,232.19元（截至2019年12月31日）；(5)判令被告二對原告第4項訴訟請求承擔連帶保證責任；(6)本案訴訟費用由被告承擔。
宏源匯富於2011年投資思源水業，並與思源水業及龐鵬遠簽署了《增資協議》《增資協議之補充協議》《業績補償協議》《業績補償協議具體落實之約定》等系列協議，在協議履行過程中，思源水業及龐鵬遠未能足額履行業績補償及股權回購義務，2020年1月，宏源匯富上訴于山東省濟南市中級人民法院，要求龐鵬遠及思源水業履行相關業績補償及股權回購義務。
2020年9月21日，宏源匯富收到山東省濟南市中級人民法院2020年9月14日作出的一審判決書，判決龐鵬遠於判決生效後十日內向宏源匯富支付業績補償款1,000萬元；判決宏源匯富有權對龐鵬遠持有的思源水業股份數額706.978125萬元股權折價或者以拍賣、變賣後的價款在判決第一項確定的債務範圍內優先受償；判決龐鵬遠於判決生效後十日內回購宏源匯富持有的思源水業6.5%股權並支付股權轉讓款72,465,232.19元；駁回宏源匯富的其他訴訟請求；案件受理費由龐鵬遠承擔450,116元，宏源匯富承擔47,760元，財產保全費由龐鵬遠負擔4,520元，宏源匯富負擔480元。
