中鋁國際(02068.HK)：華大公司被要求歸還相關到期債權
格隆匯1月22日丨中鋁國際(02068.HK)公佈，於2019年9月11日發佈《中鋁國際工程股份有限公司關於全資子公司涉及仲裁的公告》(公告編號：臨2019-061)，披露了公司全資子公司貴陽鋁鎂設計研究院有限公司(以下簡稱貴陽院)的全資子公司貴陽鋁鎂設計研究院工程承包有限公司(以下簡稱貴陽院承包公司)項目總承包合同糾紛案的相關情況。
2020年1月20日，貴陽仲裁委員會作出(2019)貴仲裁字第0727號《裁決書》，裁決如下：
(一)確認申請人貴陽院承包公司為被申請人華大公司墊資的前期費用1.5億元、工程款7000萬元共計2.2億元債權全部到期；被申請人華大公司在本裁決書送達後三十日內歸還申請人到期債權2.2億元；
(二)被申請人華大公司在本裁決書送達後三十日內支付申請人貴陽院承包公司1.5億元墊資債權的利息(截止2018年11月30日的利息為7730萬元；2018年12月1日以後的利息，以1.5億元為基數，按年利率18%，計算到該債權還清時為止)；
(三)被申請人華大公司在本裁決書送達後三十日內支付申請人貴陽院承包公司7000萬元墊資債權的利息(截止2018年11月30日的利息為18,824,516.36元；2018年12月1日到2019年8月19日期間的利息，以7000萬元為基數，按照中國人民銀行發佈的同期同類貸款利率計算；2019年8月20日至該項債權還清時止的利息，按照中國人民銀行授權全國銀行間同業拆借中心於每月20日(遇節假日順延)9時30分公佈貸款市場報價利率(LPR)計算)；
(四)被申請人華大公司在本裁決書送達後三十日內支付申請人貴陽院承包公司逾期歸還債權的違約金(以墊資款2.2億元為基數，從2019年9月19日起，按每年6%的標準，計算至墊資款付清時為止)；
(五)被申請人華大公司在本裁決書送達後三十日內支付申請人貴陽院承包公司逾期辦理抵押登記的違約金200,000元；
(六)被申請人華大公司在本裁決書送達後三十日內支付申請人貴陽院承包公司律師費120萬元、保全擔保費40萬元、保全費3,000元；
(七)駁回申請人貴陽院承包公司的其餘仲裁請求。
該案仲裁費用共計人民幣2,208,746元，由申請人貴陽院承包公司承擔662,623.80元，被申請人華大公司承擔1,546,122.20元(該4費用已由申請人向會預交，被申請人在支付前述款項時一併向申請人支付)。本裁決為終局裁決，裁決書自作出之日發生法律效力。
