白云山(00874.HK)王老吉就加多宝虚假宣传诉讼收到三份民事判决书
格隆汇8月16日丨白云山(00874.HK)公告，公司获悉，公司控股股东广州医药集团有限公司及全资子公司广州王老吉大健康产业有限公司今日收到中国最高人民法院关于武汉加多宝饮料有限公司、加多宝（中国）饮料有限公司虚假宣传纠纷一案（“1号案”）的《民事判决书》；公司控股股东广药集团今日收到最高院关于广东加多宝饮料食品有限公司（“广东加多宝”）虚假宣传纠纷一案（“2号案”）的《民事判决书》；公司全资子公司王老吉大健康公司今日收到最高院关于加多宝中国虚假宣传纠纷一案（“3号案”）《民事判决书》。
据悉，1号案内容有关公司控股股东广药集团及全资子公司王老吉大健康公司诉武汉加多宝、湖南丰彩好润佳商贸有限公司（“丰彩公司”）和潇湘晨报社虚假宣传纠纷一案的民事诉讼案件。
2号案内容有关本公司控股股东广药集团诉广东加多宝、彭碧娟虚假宣传纠纷一案的民事诉讼案件。3号案内容有关王老吉大健康公司诉加多宝中国虚假宣传纠纷一案民事诉讼案件。
（一）1号案再审判决情况：根据最高院《民事判决书》，判决结果如下：“1、撤销湖南省高级人民法院（2016）湘民终94号民事判决；2、撤销湖南省长沙市中级人民法院（2013）长中民五初字第00308号民事判决；3、武汉加多宝饮料有限公司于本判决生效之日起立即停止在《潇湘晨报》上发布包含“中国每卖10罐凉茶7罐加多宝”广告词的广告以及立即停止使用并销毁印有“全国销量领先的红罐凉茶——加多宝”广告词的产品包装；4、湖南丰彩好润佳商贸有限公司于本判决生效之日起立即停止销售包装上印有“全国销量领先的红罐凉茶——加多宝”广告语的加多宝凉茶；5、武汉加多宝饮料有限公司于本判决生效之日起十日内赔偿广州医药集团有限公司、广州王老吉大健康产业有限公司经济损失和合理费用共计人民币100万元；6、驳回广州医药集团有限公司、广州王老吉大健康产业有限公司的其他诉讼请求。
（二）2号案再审判决情况：根据最高院《民事判决书》，判决结果如下：“1、撤销广东省高级人民法院（2014）粤高法民三终字第482号民事判决；2、撤销广东省广州市中级人民法院（2012）穗中法知民初字第263号民事判决；3、驳回广州医药集团有限公司的诉讼请求。一、二审案件受理费共计17.4万元，由广州医药集团有限公司负担。本判决为终审判决。”
（三）3号案再审判决情况：根据最高院《民事判决书》，判决结果如下：“1、撤销重庆市高级人民法院（2014）渝高法民终字第00318号民事判决；2、撤销重庆市第五中级人民法院（2013）渝五中法民初字第00345号民事判决；3、驳回广州王老吉大健康产业有限公司的诉讼请求。一、二审案件受理费共计9.36万元，由广州王老吉大健康产业有限公司负担。本判决为终审判决。”
公司称，预计本次判决对该公司本期或期后利润不会产生影响。
